Update from CBNsat

We have received the following update from CBNsat regarding the Supreme Court hearing that was held today. We would like to thank CBNsat for taking time to send us this update.

This is an update on the Supreme Court hearing today.

Our initial delay in finalizing a commercial agreement with another operator was because there was uncertainty regarding whether the transmission equipment, which was initially sealed, will be released in order to re-commence the service with another operator.

We have obtained an order from the Supreme Court today to the effect that in the event an agreement is finalized with a licensed operator, the seizure of the transmission equipment will be removed. This will now speed up the negotiations. However, it was stated that the operator will need to have both the TRC licence and the Media licence.

In the meantime, the applications that we have made to the TRC and for the media licence will continue and have not been withdrawn.

We have also submitted a proposal to the Sri Lanka Rupavahini Corporation and are awaiting their response.

The next date for the Supreme Court hearing is 5th December 2006 at 10 am.

well...well...CBNSat have been lying again.

1. They told that they got MOD clearance!! - Where is it

2. They told they have come to an agreement with another operator - Where is it!!

What have they been doing?? BIG "????".

I think all these days they have been taking us to a ride. I feel so sad every month whne i get my credit card bill to see the deduction of CBNSat installement of Rs.3000/-(approx). Each time i pay it i curse the ppl who are responsible for this including CBNSat.

I do not have any hope now of CBNSat. Specially when things are done hidden from poor subscribers.

CBNSat has no adopted a very good strategy. Each time when the subscribers ask them what is happening they say " We have worked something out...something positive..but cannot disclose becuse of vested parties".
But when they come to SC they say they are not sure whether they will be allowed to operate the equipment if an agreement is signed with a licesed operator.

Did'nt SC say last time that if they come to a commercial agreement they will be allowed to operate.

What a joke!!!!

Thanx CBN for one thing, This is the first time that u actively produced ur events and this is the first time that v c info from the court in an official matter,

as with this issue, since SLT, SLRC is the only licensed operators, that means..............,

Hmmmmmmm . . . a further wait, ok, what next...

SLT?? They haven't got licensed yet.

SLT was not given any licence but they've applied and waiting to start their own service when they get it.

I thought seals had being removed to conduct test transmissions on August when CJ ordered. Can CBN tell us what kind of seal to be removed.

Still waiting for the green light! Looks as if there has been very little progress, if any,since the last time? Is CBNSat just stringing us along? If so, it would be very unfair on their customers who have, by and large, except for a few hasty ones, have stuck by them. I feel it is time now tha if they cannot get the neccessary licences, they should at least sell their operation to SLT or SLRC who will at least show us something, which is better than nothing!
Can one of you guys inform us why we cannot use the CBNSat dish and decoder to see at least the FTA channels emanating from this sattelite?

Anybody who knows what are the plans of Asset media ( own by Dialog Telecom). I belive they are having all the licence of what was given by last PA govt.

SonicNet allowed to recommence transmission through service provider

Could apply for licence under TRC and Rupavahini Corporation Act

The Supreme Court yesterday (6) granted permission to the SonicNet Technologies (Pvt) Ltd to enter into negotiation with a service provider for the recommencement of its transmission that was at a standstill for the last five months.

The Bench comprising Chief Justices Sarath N. Silva, Justices N.K.Udalagama and Andrew M. Somawansa granted this permission for the resumption of the transmission through any service provider that had been recommended by the Telecommunication Regulatory Commission (TRC).

The SonicNet Technologies (Pvt) Ltd had filed this application contending that Commercial Crime Unit Police personnel on June 6 unlawfully sealed and seized its equipment and prevented it from using its equipment and operating its services whereas magistrate did not order or authorise to do so in his search warrant.

When the matter came up before the Supreme Court, the President’s Counsel for the petitioner SonicNet Technologies submitted that the petitioner is now agreeable to transferring the equipment and business of transmission that has come to a standstill as a result of the order made sealing the equipment.

President’s Counsel Palitha Kumarasinghe for the 7th respondent TRC submitted that the TRC has considered the applications submitted by the service providers and has made recommendations to the President in respect of some of them.

In these circumstances, the petitioner SonicNet Technologies may negotiate with any one or more of the service providers that had been recommended by the TRC.

The identity of such establishment should be made known to the President’s Counsel for the SonicNet Technologies to arrange a transfer of the equipment concerned of such service providers on condition that the service providers will be granted a licence in terms of Section 17 of the Sri Lanka Telecommunication Act and that broadcast under the Rupavahini Corporation Act.Such negotiations would be entered into by the petitioner SonicNet Technologies on the basis that the order of sealing and seizure of the equipment would be vacated once negotiations are finalized.

Such order would be made on the basis that the service providers will take over the contracts already entered into by the petitioner SonicNet Technologies and its associate companies with all rights and liabilities to all proceedings in the District Court, High Court, Magistrate’s Court and the Court of Appeal will be terminated without costs.

The petitioner SonicNet Technologies may enter into negotiation with a service provider with suitable arrangements which may be for a period. This will not prejudice to the petitioner SonicNet Technologies from pursuing its application for a licence under the TRC and Rupavahini Corporation Act.

The matter was listed for a final order on December 5 before a Bench of which Chief Justice is a member.

Petitioner in his petition cited Chief Inspector U.K.Mahindadasa, Superintendent of Police A.R.Vaidyalankara and Sub Inspector L.Tilak Bandara all of Police Commercial Crime Unit –II and the IGP and the Attorney General as respondents.

Petitioner stated that Communiq Broadband Network (CBN) is an associate company situated at No. 83, George R. De Silva Mawatha, Colombo 13.

Since May 2005, it has been responsible for providing several television channels such as BBC World, CNN News and National Geographic Channel to over 20,000 homes throughout the island.

Petitioner in the petition has asked court to grant compensation of Rs 100 million and an interim order directing the respondents to remove the seal and seizure of its equipment and not to obstruct it from using the said premises.

President’s Counsel Romesh de Silva with Sugath Caldera and Riad Ameen instructed by G.G.Arulpragasam appeared for the petitioner.

President’s Counsel Palitha Kumarasinghe with Indika Idroos appeared for the TRC. Deputy Solicitor General Sathya Hetige with Senior State Counsel Sumathi Dharmawardana appeared for the respondent police officers.

After logging in click on the Package Renewal link to renew your package.
Enter the amount you wish to pay.
Select the ITZ Cash as payment option and click on submit.
Enter your ITZ Cash account number and password and click on continue.
Take down the transaction number which can be used as a reference for further details.
Multiple cards can be used for a single transaction.

All that the dealers have to do is to give us the VC number, and getdown Itz cards from India and sell it to us to pay for the DishTV subscription.

Web access is trouble and if you are doing it please get the correct details from your dealer and do it,and still its truoble and big trouble.

Hi people,

I believe if the dealers can buy a DishTV connection from India, they can also get web access for us from India. It will not be a big problem for them, I believe. May be we must request them.

What about the TRC & MOD clearence, nothing has been said about those at the hearing?

No deadline for those, the CBN lawyers should have requested for a deadline for those. They are happy to only put forward the negociations with the 3rd party at the hearing?

The order is fixed for 5th December and whatever the outcome is there want be any court case after 05.12.2006.

CBNsat will defeneitly do something and it looks good with the TRC have been asked to inform the CBNsat lawyers who the licenced operators are.In fairness to CBNsat and as Kaluperuma said,They needed this assurance from courts as an order to proceed with any commercial agreement.Since it has been received by CBN,I can assure that they will be back in due course and the two weeks Kalupreuma mentioned is a possibility.

Kamals proposal is the best way to obtain web access but still we will have the problem when paying through our CC and paying from Sri Lanka.

i wish i could help. But it seems (not confirmed, bus has a good chance) DishTV is using credit card information to track payment. In that case IP scramble will not be of any use. As we once said before, IP scramble will only conceal your internet connection's details such as location and ISP . It can not protect you if DishTV uses credit card info relayed from banks. So proceed with caution.
