CBNSat Court hearing postponed to 5th July 2006

Looks like the great Sri Lankan judicial system have done it again and they seem to be dragging the case to the frustration of thousands of Cable TV subscribers who have purchased connections from CBNSat.

The case is now postponed to 5th July 2006. Information coming in seems to be sketchy but it seems that the media ministry wants to clarify some information. Hopefully more reliable information comes in as the day progresses and our fellow bloggers will keep us updated on the information as time passes.

Looks like the officials do not have any concern for the subscribers involved in this issue, is this how the citizens are treated in this country.

We should get to gether and take CBNSat to courts. Let them come up with their version of the story, then we might get the real picture and reason for the closure.

Dear valued customer,

Further to our communication on press with regard to our transmission being halted illegally by the CID, we wish to personally thank you for standing by us and being patient. Your support has given us immense strength to face all the battles against the unfair and unjustified actions taken against us.

We wish to gratefully acknowledge and thank our customers who have sent us emails and letters of encouragement and support. Sincere appreciation also goes out to those customers who have shown their support on the blog discussion pages.

We took this matter up in Courts and had several hearings so far and the Court verdict is currently pending. We have emphasized in Courts that in fairness to all our customers a quick resolution is immediately needed.

The overnight closure of infotainment service providers has now become an industry-wide issue. We maintain that we have all the necessary licences and documents required for our operations from both the Telecommunications Regulatory Commission of Sri Lanka and the Board of Investment of Sri Lanka.

The learned Magistrate has however requested us to obtain an additional licence to maintain a “private television broadcasting station” under section 28 of the Sri Lanka Rupavahini Corporation Act No. 6 of 1982. Although we are not a television broadcasting station, solely in the interests of our valued customers, we have submitted an application for the aforesaid licence under protest and strictly without prejudice to our rights in Court.

We understand the disappointment and frustration of our customers and would like to assure you that we doing everything possible to have the services back soon. In the meantime, please rest assured that we will not be charging subscription for the period during which the services were not available.

We are grateful for your loyalty and are confident that you will continue to stand by us. Together we will see this through and have CBNSat back on air again.

Yours digitally,
CBNSat.

Dont talk nonsense. When someone falls in trouble , we need to help. Not ask for refunds.

Kiriberty, the CBNSat version of the story is well known. What is confusing you?

To see some of the people commenting here you wonder what sort of country they live in. Don't they know they live in a corrupt place where the judicial system and the industry regulators are slaves to political forces?

Get the refunds if you want - let Mahinda, his crooked bother and Hullugalle win...and the next time some other business gets in their way watch them tear it down too. Then bitch about how no one stands up to these goons. Staying loyal to CBN is one way to at least contribute in a fight against corruption. Eventually, I think the corrupt forces have so much power they will win but let's not give up so easily. Each time the excuses from the Government get weaker so perhaps there is some hope.

CBNSat are fighting against people close to the President, so this is why things are getting delayed for them. They have to be careful what they say in public because if they push things too much, I think we can all guess what will happen to the owners and their families.

Does anyone know why exactly the case was postponed? If it was somehthing related to LTTE channel why was it postponed to 5th? (thats day after tomorrow) Is it a major issue like that?

Are we all being made fools here by comet marketing guys? Can someone please verify the reason for postponement. We'll have to wait till tomorrow newspapers to actually know the truth it seems.

How does all these big hotels gets satellite TV? Is it through Comet or SATnet? For example Cheers pub is showing the worldcup matches live. Whats the impact on tourism industry so far this CBN ban had caused? If there are few foriegners here ( specially foriegner with white skin) , could you please ring up the assholic leaders of ours and ask them to get their head out of the ass pls?

With no disrespect to anybody , white foriegner with a heavy accent and in a suit can get some real work done here in SL. :)

To all comet dudes posting here,

The main point is Comet doesnt have islandwide coverage (not that i'd get it if they had)
According to you, us CBNsat jackasses must convert to comet at once :p
What is your recommendation to CBNsat subscribers who are outside colombo with NO comet signal?

Will you be fixing an antenna in your ass and walk from rural town to town broadcasting comet?

FUCK OFF!

To get back on topic, Lodge habarana used to have CBNsat. That i can confirm. I think most major hotels are using CBNsat. Acan anyone confirm the reasons for postponement?

My Dear Friends, I wrote before as well, We would not be able to see CBN-SAT for some time. This is the real fact. The case will get postponed on a reqular basis unless some one from the Chinthanaya approves. That will not happen. Who is worried about others in this Land ?

So We may not request for the refund but we have to do somethink which is legal to put preassure to get CBN back. We should march up to the Media Ministry and the BOI with some placards. The wordings to be hard to hit them. This will do some good.

This is what even the CEO of CBN SAT said in the TNL Interview on a more polite way.

See what can be done, Form a group and hv some meatings.

Well forget about COMET... After trying for days after days.... finally I managed to get thru to their sales and asked for a new connection...!! Do you know the answer I got..??

They are overbooked!!! they cannot give anymore new connections for another 5-6 weeks..!!

Even this message was delivered using extremely broken english by one of their so called "sales agents".

I suggest COMET to have two different sets of call center lines. One for Sinhala and one for english..!! Its soo embaressing when the sales guys want to start the conversation in English and they end up in a big mess!!

Anyway, this means that in this country we don't have anymore cable/sat TV connectivity!! Except for that Shitnet guys illegal connections!!

For the COMET asses who keep on posting the program list of the channels...get your act together before trying to market the product.. whats the god damn use of marketing something which you cannot deliver!!

For the CBNsat reps... its good news as at least your subscribers don't have any option other than waiting or applying for a refund, which I am not sure possible. I don't have any sort of an agreement with me to cross check if refunding is possible.

At least Channel Eye is giving LIVE broadcast of world cup since the quater finals..! Something to cheerup!! :)

I can see a person from Maldives(dhivehinet.net.mv --> this is from the local internet service provider in Maldives - Dhiraagu) is frequently visiting this blog...! May be Maldivian guys were also getting the service from CBN?? pretty interesting, isn't it?? Technically it is surely possible. But legally I'm not sure..! But, its very impressive to see that a Sri lankan Cable TV service is spreading to neghbouring countries..!!

Does anyone know where the restart button is???

I'd like to reboot this country, it's malfunctioning.

Anonymous said...

I was told by a Marketing Co-ordinator who did sales for the company I am working, that they actually have done some sales within Maldives. He also added that they wont be able to go near the Maldive market anymore as customers are furious. Thank you SL Govt for scrweing up a lucrative market!

According to DailyMirror today SLRC lawyer has said that LTTE channel and CBNSat uses the same frequency. I think here this fool refers to the same satellite. Therefore he further said that LTTE could transmit anything to CBNSat users which is a threat to national security. CID have asked assistance of INTERPOL for further investigations.

What a bunch of fools. Can't they see that on the CBNSat decoder all the other channels are blocked. Eventhough both channels uses the same satellite it's 2 different frequencies.

Wasn't there anyone who has knowledge about these technical issues to explain it to the judge. Don't CID or TRC or SLRC don't have technically capable guys like engineers ???? I think all the people here are politically appointed fools who don't have any education in these emerging technologies.

No wonder our country in this state with a bunch of idiots like these !!!

Dear Mr. President ! We have voted you to take the country forward (Rata Perata) But now we are quite sure that with these type of idiots around you this country will be like hell soon !

What are those feeds? Are they television channels?

THIS IS ABSOLUTE SHIT MAN ! CID HAD COMPLETELY FORGOTTTEN THE LICENCING ISSUE NOW. NOW THEY HAVE GONE BACK TO THE ORIGINAL STORY OF CBNSAT HAVING CONNECTIONS WITH LTTE. SOMEWAY OR OTHER THEY ARE GOING TO PROVE THAT. THEY KNOW THAT THIS IS A BASELESS ALLEGATION WHICH CAN BE DRAGGED FOR EVER.

THEY CANNOT DRAG THE LICENCING ISSUE LIKE THAT. THEY WILL HAVE TO ISSUE THE LICENCE IF CBNSAT COMPLIES WITH THE LAWS OF THE LAND.

BUT THIS LTTE ALLEGATION THEY CAN DRAG FOREVER TELLING FOOLISH STORIES TILL CBNSAT CLOSES DOWN OPERATIONS. I THINK THAT'S WHAT THESE GUYS ARE TRYING TO DO NOW !

SO UNFORTUNATELY FOR US ! THE CUSTOMERS WILL NOT BE ABLE TO ACCESS THE INFOTAINMENT.

I REALLY DON'T KNOW HOW THIS NATIONAL SECURITY ISSUE DOESN'T APPLY TO TV LANKA ??? THEY ARE ALSO DOING A SIMILAR BUSINESS.
IS IT BECAUSE HE IS A FRIEND OF THE BIG MAN ???

I DON'T KNOW WHETHER THE FACTS IN SUNDAY LEADER IS TRUE BUT THIS TV LANKA GUY IS SUPPOSED TO PAY IN MILLIONS TO SLT WHICH HE ISN'T PAYING. HE COULD DO IT BECAUSE HE IS CLOSE WITH THE BIG MAN ???

AND THE WHOLE COUNTRY INCLUDING THE TRC AND SLT KNOWS THAT THIS MAN WAS DOING ILLEGAL CALL TERMINATION THROUGH HIS NETWORK EVEN BEFORE TRC ISSUED EGO LICENCES ???? HE CAN GET AWAY WITH IT BECAUSE HE IS CLOSE WITH THE BIG MAN ???

SO MY FINAL POINT IS THAT TO DO WHATEVER IN SRI LANKA (LEGAL OR ILLEGAL) WHO HAVE TO GET CLOSE TO A BIG POLITICO ! MAY BE THE BIG MAN. UNLESS YOU WILL END UP IN DEEP SHIT LIKE CBNSAT !

You get about 11 FTA channels on that PAS 12 satellite. 5 maharishi channels, 4 blessing tv channels, ltte channel and cnbc pakistan channel.

WITH CBNSAT DECODER YOU CANT WATCH THESE BECAUSE IT'S LOCKED OUT FOR OTHER TRANSMISSIONS EXCEPT CBNSAT.

From Pettah you can buy a ku band receiver which can be used to watch these for less than Rs. 6000/= you can buy the full system for Rs. 8500/= and watch the indian DD package free to air consisting of more than 40 channels.

The place available is at peoples park shopping complex in pettah.

it is so unfortunate that he is always at a meeting. He should understand that it is us the customers who pays his salary.

As CBNsat customers we should take CBN to courts. Because there lawyers are dancing according to the gov tune

"Kiriberty" you are right.

CBN should reconsider of getting service from professional lawyers. The lawyers who’s talking behalf of CBN.. could not resolve this matter up to now.

Anonymous said...

Enough is ENOUGH……………. This will be a never ending story …as CBNsat customers we should ask for a refund…

CBN lawyers!!!!!!!!!!
DO your job in a professional WAY

CBN will be bankrupt..
Within another few months if the issue is getting drag. …… Customers should ask for the refund or else …………

Anonymous said...

CBSSat should get better lawyers!?!?!? Have you seen who they're lawyers are? These are top lawyers; it's not a problem with them it's a problem with the government.

This is a warning for all of us citizens. Even if we have million rupee lawyers, if we go against a catcher of the President like Hullugalle we will be helpless. For Tamil people it's even worse.

This is a good lesson for anyone wanting to invest in Sri Lanka under a Rajapakse government. First they take our TV stations, then who knows what next?

Anonymous said...

If CBN wins!

The new monthly fee will be 2,000++

Anonymous said...

Ranil's governmentor or Rajapakse governmentor or JVP or..

ALL ARE the same..

Anonymous said...

Guys STOP the crap
Ask for a refund…

Anonymous said...

To all those calling for refunds - yes, let Hullugalle and the Rajapakse's win. Then when the next private sector business is destroyed to help another friend of the government let that also happen...

Some of us work in the private sector. Think about what happens if our bosses are targetted by a person like Hullugalle. Today CBN, tomorrow could it be a company we work for...

If we don't stay strong for this, soon all our entertainment and luxuries we earn for working hard will go. This is a great chance for people to show we wont be bullied so stay strong for as long as possible.

Court orders SatNet closure
23/6/2006

The Island 2006.06.22- Colombo Additional Magistrate Gehan Pilapitiya yesterday ordered the CID to close down the SatNet TV Broadcasting station owned by Lakshman Hullugalle and take appropriate action against the station for violating the laws of the land by not obtaining the permission to run the station from the relevant authority.

Lakshman Hullugalle, who was summoned to appear in Court, was enlarged on security bail in Rs. 100,000.

Anuja Premaratne, appearing for Hullugalle state that they had obtained the licence to import TV equipment and sell it to customers whilst broadcasting was done from India and therefore the station had not violated any regulations under the Rupavahini Act or the TRC.

But Senior State Counsel Gehan Kulatunga, appearing for the CID said Hullugalle had violated Section 45 B of the TRC Act and came under the purview of the investigation.

The Magistrate ordered the CID to take the same steps against the other two stations under investigation as their failing to do so would be unfair.

Hemantha Warnakulasuriya and Kalinga Pasqual, instructed by Inoka Gamage appeared for the Rupavahini Corporation. Kuvera de Soysa appeared for the LBA cable TV station and M. M. Ameen PC appeared for the CBNsat TV station.

The Magistrate issued a seizure notice for the Transmission equipment of CBNsat and LBN cable TV and others. The same order was made against SatNet.

CBNSat will not give a refund, because whoever is supposed to be incharge of *REFUND BUSINESS* is always in a meeting.

Even though CBN has hired the best lawyers in the country, they would prefer more numbers of visits to courts as thats the sure way of fattening thier pockets. Else, they lawyers can take the CID to task in one hearing by ripping through the entire fiasco. CBNSat is a BOI approved company, which is a proof TRC has already approved their operation. Anyone having a 12inch Satellite Dish with a LNB unit can watch LTTE channel. Now, the TVLANKA, Eletroteks man has a Satellite Uplink facility also, because he is a Buddhist, he will not corporate with the LTTE, that will endanger our motherlands security. The fact that the Director General of Media Centre for National Security owns SATNAT means, he is no threat to this country's national security either.

Anonymous said...

"Eletroteks man has a Satellite Uplink facility also, because he is a Buddhist, he will not corporate with the LTTE, that will endanger our motherlands security."

Have you been reading the newspapers and know about the recent terrorist activities? How many Sinhalese people are taking bribes from the LTTE? Some are saying the head of the navy took part in corrupt defence purchases, which also acted against the best interests of the mother land.

Yes ! Elektroteks was anyway doing illegal call termination before 2002. And he owes in millions to SLT. Tomorrow if LTTE comes and payes him he will uplink the channel for LTTE.

You have to be a buddhist by practise. Not by birth. This mans history shows that he is not a buddhist by his deeds.

This is the man who got the contract for providing vsat solutions to ICTA "nenasala" centers. I remember CBNSat also came with a proposal at the start do do it free of charge because it's an educational thing.

And CBNSat was uplinking Rupavahini and Channel EYE also Free of Charge.

TV LANKA guy will get this deal also to uplink the state channels at a huge cost.
