CBNsat clarifies their position

This is a reply to the email that was sent by us regarding the outcome of Monday (Sept 18th) Court hearing we wish to state that we received CBNsat's reply yesterday but we were unable to publish it yesterday. We like to like to thank Legal Manager of CBNsat, Dilani Nandasiri for taking time to reply. We raised issues such as the granting of refunds and their position on signing up with another operator. Given below is their reply.

"We do understand the frustration of the customers as we are experiencing it too. We also want to be fair by all concerned and it was not the customers' nor our intention either of terminating the services. However, we are not in a position to issue refunds at the moment whether we like it or not. Therefore we appeal to our customers to continue giving us the understanding, patience and support they have been very generous with so far.

As mentioned previously, we are considering certain options, one of them being to enter into an agreement with an operator that has already been issued with the necessary license for satellite broadcasting. Hence the reason our lawyers requested the court for permission to re-commence transmission through another operator pending the processing of our application. This was done in the interests of our customers and stake holders, in order to safeguard them from more delays.

This request was granted by the Supreme Court and we were given leave to commence transmission once we finalize any necessary commercial arrangements, without having to seek further permission, so although the next date for the Supreme Court hearing is the 6th of Nov 2006, it is not necessary to wait till then.

We do not have a fixed time as yet as to when we are shall be able to start as we only obtained the court's permission yesterday (Sept 18th). However, please rest assured that the things are moving ahead and it should not be long before we are once again able to enjoy the infotainment service much missed by all.

According to this email from CBNsat they seem confident of resuming services once they sign an agreement with another operator and as mentioned previously the only two who have received licenses now is SLRC and SLT. We are also made to understand from some of our readers that out of the 26 applications, most of the licenses are for the regional cable tv operators and a few others are for satellite based services - it is not clear how many and how many will be given the license. So probably CBNsat will be able to tie up with the companies who got the license to provide a satellite based service.

Please keep us updated on any new developments regarding CBNsat as the days progress.

There is only two operators with the so called license.

So CBN does'nt have much options. Either SLRC or SLT. Out of these two, who will be more co-operative?? I think SLT is a good option as they have a good management without any political influence not like SLRC.

i agree with alf. SLT is the "less" corrupted firm of the two. And it's not totally govt owned (nearly 50% shares owned by NTT of japan).

Interesting development. I'd suspect this was the intended outcome of all the fuss and closures, but I don't attribute much intelligence to the government so maybe not.

Let's see where this goes.

I do not understand the following statement. Can somebody explain or Ms. Nandasiri can you elaborate more on this

So if CBNSat tigh up with a licesed operator can they start transmission immidietly??

Yes alfy they can once they sign a commercial agreement and there is no time frame(If they sign tommorow they can inform courts and commence transmission immediatly)

TO MY KNOWLEDGE THERE ARE THREE LICENCED OPERATORS,OTHER THAN SLRC AND TRC,BALUWARDENAS TVLANKA IS ALSO RUNNING ON A SIMILIAR LICENCE,BUT I DOUBT WHETHER CBN WILL EVEN TALK TO A DOG LIKE HIM

Thanks for the update. I guess this means CBNSat will not be reaping all the profits. They will have to pay a fee or share profits with SLT or SLRC. Well its a shame for the investors who worked hard and put in a lot. But given the siyuation "something is better than nothing".
We do admire and appreciate you taking a hit in order to keep your subscribers happy.

If CBNSat made an agreement with SLT or SLRC, I' sure this TV Lanka guy will do something else to stop it.

I already given my hopes regarding CBN. I enjoyed CBN for 10 months so I won't ask for a refund.

Anyway I wish CBNSat All the best.

Yes MATRIX,No sooner they sign a commercial agreement with a licenced operator they can go ahead and do the transmission for the interim period,Untill a proper licence is issued to CBNsat.

Its to be seen how SLRC and SLT will react to the proposal,Hopefulyy the reaction will be positive in the interest of the agrevated subscribers.

Only thing CBNsat can do is to transmit signals from another country. There's no law in our country... As Dase said top level do what ever they want...

Should not take long time if it is spelled out correctly and an attractive incentive is forwarded to the License provider.

I have a friend in CBNSAT, I met him yesterday. He said, yes they are going to link up with SLT or SLRC. But if it fails or the court case drags for long time they are going to shift CBNSAT to Maldives and start transmission.

Ask your friend for a rough date for this commercial agreement to be finalised. Or the current status of it. Whether its under negotiations, drafted, sent to SLT/SLRC etc.

Very good and correct point. In a perfect, law abiding country. Yes. But we all seem to keep forgetting this is Rajapaksa and the clan land. Laws are only meant to be used as and when they want, and how they want.
Otherwise why would any PREZ need 53 people to go to Havana and New York for two weeks, just for a 6 minute speech?

Case in point: CBNSat and LBN out while COMET and SHITNET is on. COMET has the Fashion TV channel too.
So no matter what Shitnet can do, doesn't mean CBNSat can bring that up to justify their case. There is absolutely no fairness and proper justice in this land. If there was, we will not be bitching like this on this blog.
In fairness to CBNSat, they may have been trying to hold on to their investment and tried their best to continue operations here. So we have to give them a break. Maybe now is the time to start looking outside of Rajapaksa Land to transmit.
Lets give them time to get their act together. Remember guys! They have an easy way out. They can blame it on the authorities, find loopholes and file for bankruptcy and get their money back. Then we will all be screwed. So lets work with them and try to get this damn thing on. It may take a little time and patience on our part.
I know it sucks. But I guess we have to learn to adjust and live in Raja Land. All because a majority of the MOFOs in the country made him the PREZ. Now we all have to put up with the shit.

Although they are looking at tying up with SLT or SLRC, at the same time they could look for the possibility of tying up with an Indian Operator for the uplink. I think this should be chaeper as India should have many uplink license holder as oposed to just two in Sri Lanka. Thus effectively reducing the price. I beleive there are more possibilities like this at this moment.

Hi ALF and BLOG ADMIN, please follow PROPER AUTHORIZATION PROCEDURE to evaluate whether a user is an actual CBNsat customer before sending details to ALF & vice versa.

Checking name and account id wont help since those details are already shown on the online petition. So anyone can get those details and play as a CBNsat customer. So please follow proper authorization procedure.

Wonder who CBNsat Rep... is.

The figures we are getting do not match his/hers. We hear that some of the sales people have left since there are no sales and most of their salaries are on a comission basis. So it is understandable that they have left. Some Call Centre officers have also left. But there are no reports of mass dessertion of CBNsat by its employees and most of them are still holding on.

Even if CBNsat Rep is correct. We are talking only of 20 employees out of 300 which still leaves 280 employees.

Anyway the employee turnover in departments like Call Centre are generally high since young people find call centre jobs only for a short time till they complete studies or find a permanent job in another field. So for any company this is normal but in CBNsat's case they will not replace till they get themselves back on track.

On the agreement with SLT or SLRC since a commercial agreement has to be signed it will take time since they have to work out the prices, etc.

However we do not know the status of the deal with SLT & SLRC, however we request those of you who have full details not to post them here since there are prying eyes who will keep watch to put a stop to this deal also. If you have details of this deal please email it to us.

We hope "CBNsat Rep" is really from CBNsat and not posing off as someone from CBNsat, giving out false information.

My opinion is/was that CBNSat should take operations out of Country or sell the business to a Management that can handle the Government. Ideal person is HarryJ or SLT.

The current Management is too young and immature to handle these kind of sensitive matters.

Anyway i am not looking forward now for commencement of operations as it is just a mirage.

The admin is right and the number of employees who have left CBN less than 5 and yes,Its not easy in getting a agreement going with SLRC & SLT as both are government ventures and these are influenced by the same people who wants CBNsat destroyed.

There is nothing wrong with the legal team of CBNsat and everyone should understand that it has been taken above the law by the rulers of this country.

There is nothing we or the management of CBNsat can do without the direct intervetion of the presdident of the country.

I have lost my faith with CBN now. I can’t afford to go for another operator. So I’ll wait till they resume transmission on some day (looks like not) and keep the Dish & the decoder to look and enjoy that I had such a facility. I believe most of you guys are in the same position like me.

How is the "new service"? Is it up and running? Is it digital? Do they have STAR WORLD, STAR PLUS, ESPN, STAR SPORTS, AXN and other good channels? Was it cheaper than CBN?

guys give the lawyers and CBNsat legal team a break. I for one know they tried their best (still trying). Even if god's lawyer team were to be assigned for this case, there wont be any progress coz in srilanka, robbers have more powers than gods.

Going by the happenings in the past few months, it now seems that CBN would not be able to commence transmission for at least another year. The latest news from ITN revealed that TRC has decided to develop a “White paper” detailing out the criteria for any new company to obtain licence for broadcasting. It will take 6 months or so. The Attorney General will study it and make revisions, if needed, and forward back to TRC. Thereafter it has to tabled in the Parliament as an Act by the Minister concerned.

In this situation CBN should refund the deposits taken from us or pay the prevailing bank interest. Their failure to adapt to the proper legal conditions is no concern to the customer.

We have waited enough. There are other channels we can use. Yet, I do not think we should leave our money in a project which is going to be inactive for a long time. It is not what we have been promised. It is time we get together, like Pramuka customers, and fight for our rights.
