CBNSat Case postponed till 28th July 2006

Reports are coming in that the Court Case has been postponed to 28th June 206. If this is true then it is a very long wait as it will be held next Wednesday which is exactly one week away.

Only time will tell of what transpired in the courts today. Please keep this forum updated with the breaking new throughout the night.

It looks like the Media Ministry needs more time to decide on the license or something like that.

Whenever you think it could be great to live here, then she comes and gets you. Does not matter if it is the shutdown of CBNSat, the corrupt policemen at the street corner or the selfishness and total aggressivity of the people you meet in Colombo traffic everyday. What matter is, that Mother Lanka always hits you right where it hurts. Thank god, I have only a few months left here.

It has been postponed to the 28th JUNE 2006 and the SHITNET and LBN cases to 05th July 2006.

The media ministry secretary has asked for one month to process the application(When a loud hush came from the people inside the courts) and even the Magistrate had laughed and has advice him to revert back by 28.06.2006 and if he doesnt bring an answer the case will be dropped and whatever cirumstances CBNsat will be on air by 28th OR 29th.

Now the CID is ok with everything and its the guys from the media ministry who are pulling the shoe.

one month to process a application is a joke, good that the judge gave a time frame and also that they will drop the case if the media ministry doesnt respect the courts. The ministry should be taken to courts for contempt of court as it is more likely another donkey story will be brought forth on 28th June.

Yeah ! I also thought so at the very beginning ! Because it was perfectly timed 3 days before the world cup started ! 6/6/6

The people who started this know that they can't get away with it. The only thing that they can do is drag this until the world cup and Engalnd tour is over !

I think we'll have to wait till 5th July for the LBN & SHITNet cases to finish for CBN to be on air !

They can't ban all the operators ! Isn't it ! What they can say is to regularise the operations.

I think this is a major blow to the CBN marketing campaign too. This is the best time to get some new connections installed and I think they were geared up to do so in this month with the FIFA cup and the england tour.

They could have easily sold 5000 connections !

See the lives of the 300+ Employees and 100,000+ viewers is in jeopardy because of Hullas SHITNet.

Next hearing on 28th of JUNE. (only 6 more days)
First of all guys, it's not a defeat for CBNsat. It is just a delay. It is not the end of the world and hope is still there :)

They will not be able to drag this case any further than 28th. Judge ordered to answer the big question

with a YES or a NO. Shemale words such as MAYBE/LATER/FORGOT/COULDNT (or any word that are frequently used by govt officials in SL) means case dropped and CBNsat back. So either is has to be a yes or a no on 28th. Even if it is a NO, they will have to provide reasons. Lame reasons will fails coz the judge is not a child. It is most likely that CBNsat will be back on air on or after 28th.

I wish all the best for CBNsat and LBN (maybe comet too if they get into trouble). I waited 2 weeks, one
more is nothing.

now they need a license from TRC! it was said earlier and accused cbn that they needed a license from rupavahini corporation..... the story is now they need a new license from TRC. this is to pluck money from cbn saying its for the license!
r they having child play or when are they going to act like grown up decent human beings?

We should file a fundamental rights case against the media Ministry for preventing us watching the World Cup and the Cricket Matches. Since they are not going to stop the event till the CBN case is over. It’s also the negligence on the part of the BOI authority and they too should be sued for not doing their part by informing the client what have to be done before a project begins. Since this is SL there is no proper person who thinks of his duty and the mistakes are taken as part of his routine.

its only clear that anyone who invests in this sorry sod country will be sorry for life!
just bcoz the ceo is a tamil, all his hardwork and effort has been squashed! the govt of this country shud be backing up this sort of businesses which give employment and opportunities for other related industries.
saddest thing is, the judge is still not giving a decision to start the operations, as it was unlawfully shut down, even before any inquries.
i ask one question. if they first said rupavahini license, then now why are they saying another license from TRC?
there is something very fishy here, and everyone should note that this is not a one man related thing anymore.
yes, hulugalla may have started this, but now its dragged on by more people, and we wish to know why?
if national security is the question, then why dont they station at cbn sat premises and watch 24/7. this will solve the problem instantly, coz, if there is some illegal transmission, they can immediately shut it down. But now whats happening is, only the staff and customers and all the stake holders are inconvenienced.
who is going to pay for all the losses? does the govt of srilanka know the estimate of this cost? can they even afford to repay something like this?
all the pain and trauma caused are immeasurable! the injustice done is immense!
why is everyone so quiet?

Does he have a license lets question the authorities on what license he has. Is this also another political connection ?

Alleged LTTE connections led to investigations against certain private TV channels - Senior State Counsel

Colombo: Senior State Counsel Gihan Kulathunga yesterday submitted that the Criminal Investigations Department initiated the investigations into private television channels when the CID was informed that certain channels were allegedly helping the LTTE to transmit their necessary information.

SSC Kulathunga submitted it before the Colombo Additional Magistrate Gihan Pilapitiya when the cases against CBN Sat, LBN and Sat net were taken into consideration.

SSC Kulathunga said while that investigation was in progress the CID found that these channels were functioning without a valid licence.

The Court granted Managing Director of LBN Shivantha Herath, Managing Director of CBN sat Muhanda Kanage and Managing Director of Sat net Laxman Hulugalla Rs. 1,00,000 personal bail.

Attorney Kuwera de Soyza appearing for the Lanka Broadband Network said that their company was a BOI approved company and their company was sealed on June 15, by the CID came with a search warrant. They were not aware yet for what reason it was revealed.

Although they requested for a copy of the search warrant from the CID they did not get it. He submitted that the CID has gained the search warrant hiding certain facts to the court. Since their company was a BOI approved company if any order was issued with regard to such companies it should be done following hearing to their submissions.

The Defence Counsel said that LBN possesses a licence to import equipment, repair, maintain and install those equipment and a broadcasting licence. SSC Gihan Kulathunga stated that LBN does not have the licence from the Rupavahini Corporation and the licence from the Sri Lanka Telecommunication Regulatory Commission for the function of this television channel.

Defence Counsel de Soyza said that they had no objection with conducting investigations but asked that they be allowed to continue transmissions.

SSC Kulathunga said that if the equipment was brought it would cause damage that the CID sealed them and if the relevant authorities inform the court that they were considering giving them the licence he had no objections to them being allowed to resume transmissions.

Attorney Anuja Premaratne appearing for the Sat Net said that their company was not doing any transmission. The transmission was being done from India and their company was only providing an apparatus to customers to receive programmes transmitted from India. Sat Net has the licence to import this apparatus sell, install, maintain and repair and that is what's our company doing.

SSC Kulathunga said that their company was charging a monthly fee from their customers and Defence Counsel said that they were the agent of the Indian company. Thereafter SSC Kulathunga said that it was illegal.

The Judge ordered the CID to submit a further report after investigations on July 6 since the CID requested for more time for further investigation.

Additional Secretary to the Media Ministry Vajira Narampanawa told Court that he handed over the application form of the CBN sat company for a licence to the ministry. He said that the applicants have to fill up other documents which is required from the Ministry and when those requirements are fulfilled the Minister would consider if the company could be given the licence. According to his experience it takes nearly four weeks for this process.

The judge observed that four weeks was too long and instructed to Additional Secretary to inform the court that if it were in a position to issue the licence or not on June 28.

Kuvera de Soyza appeared with Sumedha Mahawanniarachchi for LBN instructed by Sudath Perera Associates.

Senior State Counsel Gihan Kulathunga, Senior State Counsel Sumana Dharmawardana, Senior Superintendent of Police Ravi Vidyalankara, Sub-inspector M.R. Dayaratne appeared for the prosecution while President's Counsel M.L.M. Ameen, President's Counsel Ikram Mohammed, Ian Fernando, Sadi Wadud, Riyad Ameen and Sajeewa Antony appeared for the defence.

President's Counsel Hemantha Warnakulasuriya appeared for the Rupavahini Corporation.

CID could immediately see whether CBNSat or SonicNet is linked to LTTE if they really wanted it !

After they turn down the SonicNet equipment and seal CBNSat if LTTE is using that network their services should also go down !

But all this time NTT (National Television of Tamil Eelam) and the Voice of tigers radio channel is working fine. Even their Satellite broadcast is also up and running without any problem.

So why can't these fools understand that they do not use CBNSat or SonicNet Infrastructure ?

We all know that tigers are broadcasting their TV, Radio channels and making voice calls by using the VSat equipment and other equipment they brought down in 2002 with the help of then government and Norway !

Why can't air force bomb this location in Vanni as it could be seen from above ?

We all know that for a satellite transmission there should be line of sight between the satellite and the uplinking station !

So they can't hide this dish in a jungle or a bush or underground and transmit !

So it should be visible from above.

So why can't we bomb this and finish off their links with the outside world ?

Without doing it and unneccesarily harrasing tamil people here will create a bad image for the government.

I think few bunch of corrupt government officials are misleading the government ministers and the president.

Our infamous SHITNet guy is only one of them. There may be a bunch of others !

Court orders SatNet closure
Thursday, 22 June 2006 - 4:21 AM SL Time


Colombo Additional Magistrate Gehan Pilapitiya yesterday ordered the CID to close down the SatNet TV Broadcasting station owned by Lakshman Hullugalle and take appropriate action against the station for violating the laws of the land by not obtaining the permission to run the station from the relevant authority.

Lakshman Hullugalle, who was summoned to appear in Court, was enlarged on security bail in Rs. 100,000.

Anuja Premaratne, appearing for Hullugalle state that they had obtained the licence to import TV equipment and sell it to customers whilst broadcasting was done from India and therefore the station had not violated any regulations under the Rupavahini Act or the TRC.

But Senior State Counsel Gehan Kulatunga, appearing for the CID said Hullugalle had violated Section 45 B of the TRC Act and came under the purview of the investigation.

The Magistrate ordered the CID to take the same steps against the other two stations under investigation as their failing to do so would be unfair.

Hemantha Warnakulasuriya and Kalinga Pasqual, instructed by Inoka Gamage appeared for the Rupavahini Corporation. Kuvera de Soysa appeared for the LBA cable TV station and M. M. Ameen PC appeared for the CBNsat TV station.

The Magistrate issued a seizure notice for the Transmission equipment of CBNsat and LBN cable TV and others. The same order was made against SatNet.

I can't stop wondering how these ministry guys disobey direct orders from a court of law and get away with it. as i understood this sloth (slower than a sloth, definitely) had to tell whether it's possible or not yesterday. One month for a simple yes or no!!!! outrages. one month to get their palms greased adequately!

Well, i thought judge gave his word to end this issue yesterday. But it has been again rescheduled for 28th. What if the Media Sec. comes and tell that they cannot issue a license for CBNSat??

I am a keen customer of CBNSat awaiting resumption of service. I feel that CBNSat is not doing much to get the attantion of relevant ppl to get this sorted out. If i was in the Board i would crab this oppertunity to do some Marketing(sympathy strategy) as well and carry out a full public campaign to get the Services up. They could have used News papers, posters etc to do some public campaigns. Also with a staff strength of 300+ and customer base of 20 000+ they could have organised some protest some where(not violence) to expose these so called ppl who benefit from our tax money.

All these things makes me think whether CBNSat has something to hide from their Customers.

I have been following the court case from the start and it seems like a cartoon. Are the so called lawyers of CBNSat capable enough to handle this case?? I start having doubts now!!

I feel this Blog is more active than CBNSat. It's time for them to get into action now since it is obvious that this entire scene is a joke unless there is something we poor customers don'nt know.

all this is pointing to one thing....that is fifa world cup. the national televation station has obviously spent some money buying tv rights and they don't want anybody rendering this effort null and void. if i have ESPN live on my TV why would I watch half-matches? guys i'm pretty positive we'll have to wait till the world cup is over. all of us thought that there is going to be a decision yesterday and what happened? the inefficient blokes wan the battle. the war is not over yet. that we can be assured about. how long we'll have to wait is the question. if people of this country start doing their job rather than satisfying their superiors, things wouldn't have reached a boiling point in this country. i see these things signs with regard to where this country is heading. people going on strike, ministers pay hike, people fighting on the road, roads filled with garbage, fuel price hike, country in the brink of another war, rise in interest rates....we could go on piling isn't it?

In my openion CBNSAT needs to be very careful the way they handle this as this issue is backed by political preasure. If they become more aggressive then it might back fire, and all customers will suffer. Since they have the best lawyers in town i am sure they have been advised properly.

I also noticed that now TRC website is inviting bidders for cable / satelite TV licences !

Now it definelty not an Rupavahini licenece but a TRC licence they require - which is of course a new one now !!!

I think everyone is now interested in getting into the business, and wants to make money out of this especailly the polititions !

I personally feel that CBNSAT is handling it very well, rather than make allegations against anyone. I guess their objective for now would be resume the business, and satisfy the customer requirements.

Minister of Media wanted one month to grant a letter to CBNSat, (but the Judge said thats too late, I'll give one week), he is too busy sleeping with the beauties supplied by Hulugalle. Minister of Media was the Chief Guest of the opening ceremony of SATNET (STAR TELEVISION LANKA PVT. LTD) or DishTV. Media Minister and his loyal officials draw a salary from SatNet. I am sure some at SLRC and TRC are too.

CBNSat lawyers are handling the case well. yes quite agree with that since the thing would have got buried permanently a long time ago, otherwise. a good demonstration of professionalism and diplomacy, which unfortunately are two traits very scarce in our country. you cannot win any race without these two traits. hopefully things would take a good turn next wednesday. HOPEFULLY!!! i think even the complicated of prediction algorithms cannot predict what would transpire in this country given that the entire variable pool is currupted and belongs to the outliars' range.

as i see it, even the officials are not sure which licence CBNSat requires. there are problems in this country that have dragged on for the better part of post independance and officials are worried about whether CBNSat has a licence or not. what a pitty. why don't they behead the guy who stole 3.5 billion rupees of people's money? every corner of this country is stinking. i never thought of going back abroad soon. however, looks like i'll have to leave sooner

there is section called consumer protection section at the TRC website. as consumers we could make complaints to the TRC that services have been off-air for the last 18 days and take necessary action to put it back online. they have the responisibility to protect our interests according to their mission statement
