Chief Justice Upholds Justice

As reported earlier Chief Justice Sarath N. Silva has given a landmark decision upholding the reputation of the legal system and taking into consideration the business image of sri lanka and the plight of the subscribers who have invested in CBNSat connections. Your Honour we salute you and thank you for what you have done.

Here is some information coming from the CBNSat Subscriber Unite Group. Media Ministry Secretary Mr. Ganegala has contacted the CBNSat Subscriber Unite Group today at approximately 9 AM and in a telephone conversation that lasted about one hour, he explained the need to make necessary amendments to facilitate such operations and was also willing to co operate fully with the subscribers. He understood the grievances of the subscribers and assured that a solution will be given as soon as possible. Mr. Ganegala we would like to thank you for the concern you showed for the subscribers of CBNSat.

According to the Supreme Court ruling the seals on the CBNSat equipment will be removed either today or tomorrow and test transmissions will commence soon in order to service the equipment that were kept shut off for a period of almost two months. It is not clear whether the test tranmissions will be in the form of broadcasts or some other form. But it is certain that CBNSat will resume transmission on or before August 23rd 2006.

We would also like to thank the management of CBNSat for not giving up and continuing to keep fighting for their rights. The fighting spirit is very much appreciated. Our minds are taken back to the story posted by one of our readers as a comment quoting the story of the "Judge and the Widow" from the Holy Bible. In the story the widow persistently asks for justice from the judge and finally she gets the justice she deserves. CBNSat your customers are definitely with you and will see you through till the uplinking is done and thereafter. Mr. Muhunthan Canegay we applaud you for standing up and fighting with your team in the time of crisis. CBNSat's technological superiority will definitely be an advantage for Sri Lanka as a whole from the city dwellers to the rural masses.

The CBNSat Subscriber Unite group which was formed amidst all these storms must not be forgotten and we hope that this group will continue to function and expand into a fully fledged lobby that fights for the rights of consumers as a whole.

Well finally it is not over still and we have to see CBNSat back on air with regular programming and we hope that things will now unfold without any problems. Please keep updating us on any developments as the day progresses.

good work blog admin!! Hats off to you mr Lisura and every one else who have been fighting for customer rights, Human rights(right to be informed), and legal rights of cbn sat. Hats off to all of you. I didn have faith in the CJ but I guess I was proven wrong. But Keep in mind guys this might be a temporary thing just to scilence the mass customer base that CBN has. This may prove to be another gimic. So please be caucious and never let your game down, I played rugby for school and what I have been thought all my life is that " the good teams play their best rugby in the final 15 dying minutes of the game" so plz be on alert.

Regardless of what happens to CBNSat , I am personally glad to see a dedicated set of people working for a cause.What we lack in this country is the dedication , commitmment and professionalism. I think we can be happy atleast that there few of us left who can maintain and work towards a cause in a very methodical dedicated manner.Keeping this blog alive has given hope to many who are thoroughly dissapointed in the current government surpressing policies. Keep up the goodwork.

p.s - Whats the home address of media minister ? Can we send year 8 science school book to him to understand the basics about sattelites and other technologies? Jeez!

Seems CBNsat won round 1!

But dont let your guard down guys. They are still not completely on air. (they surely will be)

But this is srilanka. The crooks that shut it down for 2 months are still at large. I bet they are making another plan to take it down as we speak.

But next time we'll be prepared. Next time, they'll have to go through us.

Details about todays ruling were broadcasted by almost all the tv and radio channels and even sirasa. According to Hiru FM, media ministry has asked for another 1 month, but the judge has ordered them to give the required licences asap before 23rd oof august.

They even braodcast the news on Rupavahini. They told that the court has orderd Media Minister to issues the licence very quickly. This is quite suprising to me Rupavahini reporting a news against there minister? Bit fuzzy... We have to wacthout..but hope things will be surely ok

I wonder what kind of assumptions they are going to come to make it unavailable by the 23rd....
so dont keep your hopes up for the 23rd CBN isnt on air as it is.

CBNSat wins court order for test transmission


Aug 03 (LBO) – Sealed cable television company CBNSat said Thursday that they had won a court order for a two week test transmission and to service its broadcast equipment.

“At a court hearing held on August 3, the Chief Justice ordered the relevant authorities to take necessary measures to remove the seals from equipment for maintaining and servicing purposes as well as commencement of test transmission,” the company said in a statement.

CBNSat was shut down in June this year and equipment of affiliate company SonicNet Technology sealed by authorities for allegedly operating without the required broadcast licenses.

The company took the case to courts and sought an order to resume operations and maintains that the shut down by the Criminal Investigations Department (CID) was unlawful.

CBNSat is to have a meeting with the Telecom Regulatory Commission and the media ministry over issue of any licenses, Dilani Nandasiri, Legal Manager of CBNSat said.

“Once an agreement is made within the given two weeks, the Magistrate’s Court and the Supreme Court have to be informed of this, after which transmission to subscribers is expected to commence.”

It was said in the morning news bulletin of Neth FM that the president had directry intervened and given orders to the Media Minister to issue the licence to CBNSat without any further delay.

Hopefully the CID will remove the seals today the CBN will service their equipment and start a test transmission soon. We are not very clear whether this could be received by the subscribers but at least they will be on air on and off.

Everything should be ok by 23rd max. May be before that !

This is a good lesson for all of us on how to fight for a common cause unitedly !!!

i was just going through the bench that gave the landmark judgment on CBNsat yesterday and just found out something smiliar of CJ Sarath N Silva and judges Nissanka Udalagama and Andrew Somwansa.

1.All three are Old Boys of Trinity College Kandy.

great effort and work of CBN and subcriber group.

Lets keep our ears and eyes peeled for developments in the ground situation.

It is just one battle we won although important it is, there are some more battles ahead which we have to win in order to win the war for CBN to be fully restored to its fomer glory.

Hats off to CJ and the bench for making a land mark decision addressing the unethical business pratices by some and grievances of customers.

Can somebody tell me in clear terms whats this verdict actually means?

1. Can CBNSat start test transmissions immediately?
2. When can CBNSat definitely start the commercial broadcasting?
3. Can there be reversal of supreme court judgment in light of any new "undiscovered" information from this crooked government

Well, personally that's OK with me as long as the fate of CBNSat is going to be positively resolved.

Hopefully the affected people will remember this when the pay back time comes. The political nature of this country has not changed for last half a century, don't expect it to change soon either.

Let's hope the remaining 11 or 19 days will pass uneventfully. Damn, I miss Discovery and NGC !

As a committee member of subscriber unite, I would like to thank Lisura for his indefatigable efforts to keep everybody's hopes alive. With the first meeting we had on 27th July, this process has carefully guided by Lisura with remarkeble dedication.

All the support, updates, informations and suggestions from rest of the committee members were funnelled to Lisura who has put all bits and pieces together. The time and resources he has put in, cannot be valued by money.

Thank you very much Lisura. Unfortunately I cannot reveal his real name at least until CBN sat goes On Air.

Though this is little ackward, on 27/July where did you all guys meet ? I and few of my freinds (all CBNSat customers) arrived at Vihara Maha Devi Park Buddha statue to find no organizers. This is being asked for informational reasons.

They surely have forgotten the phrase " You cant fool all the people all the time.
My warm congratulations for all those who stood together and fought as a team. Keep it up as such actions will be required in the future too as my belief is that we have not seen the end yet.

Well, Lisura, there was about 8+ guys hanging around there. Probably like me and my two colegues, have not got the message correctly. Later I thought if you ever planned changing the location of the meeting at least inform that you would be changing the location but not location it self, such that less informed would not have wasted their time.

Thanks for your efforts, but no thanks now I am not interested. Hopefully the CBNSat closure drama is over forever (at least I hope CBNSat lawyers will make sure that will remain so).
